Terms & Conditions

These Terms & Conditions are between TeacherBuilt Learning, LLC (“TeacherBuilt Learning,” “we,” “us”) and the parent or legal guardian (“you,” “parent”) using this website or enrolling a student for tutoring services. Please read these terms carefully. By using this website, booking a session, or enrolling in our services, you agree to these Terms & Conditions. When you enroll, you will also be asked to sign this same agreement electronically as part of enrollment, confirming your acceptance of these terms, including the specific authorizations in Sections 6 and 7. The specific authorizations in Sections 1, 6, and 7 take effect only when you sign this agreement at enrollment.

1. Parent/guardian attestation

By signing this agreement, you confirm that:

• You are the parent or legal guardian of the student named in your enrollment (“the student”).
• You are 18 years of age or older.
• You have the authority to enter into this agreement on behalf of the student and to consent to the terms described below, including Sections 6 and 7 (Transcription and Recording).

2. Services

TeacherBuilt Learning provides online, one-on-one and group academic tutoring delivered remotely via video call. Tutoring is provided by TeacherBuilt Learning's tutors, who are Massachusetts-certified teachers.

3. Payment terms

• Hourly (pay-as-you-go) sessions: An online payment request is sent at the end of each session, at the published hourly rate for the relevant subject/level. Payment is due promptly upon request.
• Membership plans (billed monthly): An online payment request is sent at the beginning of each billing month, in advance, at the published rate for the selected plan. Payment is due promptly upon request.
• No proration for early departure. If a student ends a scheduled hour-long session early, the full hourly rate still applies.
• No refunds. All session and membership charges are final once paid. This applies even if the student subsequently discontinues tutoring.

4. Cancellation policy

Scheduled sessions may be cancelled or rescheduled up to 3 hours before the scheduled start time at no charge. Cancellations made less than 3 hours before a scheduled session, or missed sessions, will be charged at the full applicable rate or counted toward the monthly membership allotment.

5. Membership renewal disclosure

If you enroll in a monthly membership plan:

• Your membership renews each month until you cancel. At the start of each billing cycle, we will send an online payment request for the plan's published rate; you agree to pay this promptly to maintain your membership. Payment is not charged automatically — TeacherBuilt Learning does not store or automatically charge a payment method at this time.
• You may cancel at any time by emailing support@teacherbuiltlearning.com. Cancellation will take effect for the following billing cycle; payments already made for the current billing month are non-refundable (see Section 3).
• Membership pricing and included sessions are as published on our website at the time of your enrollment and are subject to change with notice to enrolled families.

6. Transcription authorization

• Automatic transcription is enabled by default for every session. Unlike recording (see Section 7), transcription applies to every session.
• By signing this agreement, you authorize TeacherBuilt Learning to transcribe all tutoring sessions.
• When joining a session, a participant is notified that the meeting is being transcribed. Remaining in the session means accepting transcription; a participant who does not want to be transcribed must leave the meeting, which means the session cannot take place. There is no way to remain in a session while opting out of transcription.
• You also authorize TeacherBuilt Learning to use session transcripts to help improve our tutoring programs, which may involve business-tier AI tools that, under our business agreements with those providers, do not use our data to train their underlying models. See our Privacy Policy for further detail.
• Transcripts are handled as described in our Privacy Policy, including who may access them and how long they are retained. By signing this agreement, you are agreeing to the terms of our Privacy Policy.

7. Recording authorization

• By signing this agreement, you authorize TeacherBuilt Learning to record video/audio of tutoring sessions at the tutor's discretion. Recording is not used for every session, and is separate from transcription (see Section 6), which cannot be declined.
• You retain the option to decline recording for any individual session. Our video platform will prompt for confirmation before any recording begins; declining at that time will not affect the session itself, which will proceed as scheduled without recording.
• Recordings are handled as described in our Privacy Policy, including who may access them and how long they are retained. By signing this agreement, you are agreeing to the terms of our Privacy Policy.
• The authorizations in this section and Section 6 remain in effect for the duration of the student's enrollment and continue to apply even if TeacherBuilt Learning's recording or transcription practices change. If we make a change to these practices, we will notify you as described in our Privacy Policy; your continued enrollment after that notice constitutes continued consent, and you may cancel at any time if you no longer agree to the practices as changed.

8. Assumption of risk and limitation of liability

• No guarantee of results. TeacherBuilt Learning provides academic tutoring support but makes no guarantee regarding grades, test scores, academic outcomes, or admission to any program or institution.
• Technology and connectivity. Sessions are delivered via third-party video conferencing software. TeacherBuilt Learning is not responsible for internet outages, software malfunctions, or other technical interruptions beyond its reasonable control, whether on TeacherBuilt Learning's end or the student's/parent's end.
• Limitation of liability. To the fullest extent permitted by Massachusetts law, TeacherBuilt Learning's total liability arising from or related to these services is limited to the amount of fees paid by you for the sessions or membership period at issue.
• Exclusion of consequential damages. To the fullest extent permitted by Massachusetts law, TeacherBuilt Learning is not responsible for any indirect, incidental, or consequential damages resulting from any issue with our product or service.
• Assumption of risk. You acknowledge that online tutoring, like any service delivered over the internet, carries inherent risks (including but not limited to service interruptions and data transmission risks), and you accept these risks in choosing to enroll.

9. Right to decline or discontinue services

TeacherBuilt Learning may decline to enroll a prospective student, or may discontinue services to an already-enrolled student, for any reason or no reason, at its sole discretion. If TeacherBuilt Learning discontinues services to an enrolled student, any unused, already-paid portion of that month's membership fee will be refunded; this does not apply to fees for sessions or time already delivered, or to sessions cancelled under Sections 3–5.

10. Governing law

This agreement is governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any dispute arising from this agreement will be resolved in the courts of the Commonwealth of Massachusetts.

11. Changes to this agreement

TeacherBuilt Learning may update this agreement from time to time. We will notify enrolled families of any material changes. Your continued enrollment after notice of a change constitutes acceptance of the updated terms. This agreement, as signed, remains valid for the duration of your enrollment and does not need to be re-signed for routine updates.

13. Acceptance

Using this website, booking a session, or enrolling in our services constitutes your agreement to these Terms & Conditions. At enrollment, you will be asked to sign this agreement electronically, which serves as your formal acknowledgment of Section 1 (Parent/guardian attestation) and the authorizations in Sections 6 and 7 (Transcription and Recording).
